GENERAL TERMS AND CONDITIONS
1. GENERAL INFORMATION
These General Terms and Conditions regulate the relationship between OPG JAKŠA BEDALOV, Biskupa Frane Franića 16, 21214 Kaštel Kambelovac, Croatia, OIB: 18354073422, as the service provider (hereinafter referred to as "the Winery") and the guest or contracting party (hereinafter referred to as "the Guest"). By accepting these General Terms and Conditions, the Guest confirms that they have read, understood, and agreed to comply with them. These General Terms and Conditions form an integral part of the contract unless otherwise agreed by the contracting parties.
2. MAIN FEATURES OF THE SERVICE
Sadržaj, program, cijene, su objavljene i dostupne na web stranici Vinarije https://vinabedalov.com/ i uključuju sadržaje navedene u opisu. Pojedine posebne i dodatne usluge koje nisu uključene u objavljeni program i sadržaj, Gost može zatražiti, a Vinarija, ukoliko ima tu mogućnost, može ih ugovoriti i uključiti u Ugovor. O cijeni posebnih i dodatnih usluga, Gost će biti obaviješten prije rezervacije ili sklapanja Ugovora i plaćanja.
3. RESERVATION PROCESS
The Guest may make a reservation via email, the reservation system on the Winery’s website, or by phone. When booking in any form, the Guest voluntarily provides the required information requested via the reservation system, email, or phone. The Guest guarantees that they have provided the Winery with correct and valid information necessary for the proper execution of the service and accepts all legal obligations arising from the contract and applicable regulations. The Winery undertakes to protect this personal data. A reservation becomes valid when a deposit or the full amount for the requested service has been paid. The full amount must be paid by the agreed deadline; otherwise, the reservation will be canceled.
4. PAYMENT
A deposit or full amount is payable depending on the selected service (unless otherwise stated in the service description). After successful payment, the Winery issues an invoice and a voucher, which serves as a booking confirmation and must be presented upon arrival at the Winery. Payments can be made: Online (credit card payment) via the integrated online payment system.
5. SERVICE PRICES
The prices of services are published in the service descriptions on the Winery’s website, https://vinabedalov.com/en/, and are valid from the date of publication. All prices are expressed in euros (€).
6. CANCELLATION BY THE WINERY
The Winery may cancel a booked service up to 12 hours before the scheduled start time for reasons that do not constitute extraordinary circumstances beyond its control. In such cases, the Guest is entitled to a 100% refund of the amount paid. The Winery may also cancel or interrupt a service at any time before or during the service if extraordinary circumstances arise (e.g., war, unrest, strikes, terrorist activities, natural disasters, pandemic outbreaks, etc.). In such cases, the Guest is entitled to a 100% refund of the amount paid, without any additional compensation. If a cancellation occurs, the Winery may offer the Guest an alternative date or program. The Guest must respond promptly to accept or decline the alternative. If the Guest rejects the changes or does not respond, the contract is terminated, and the Guest is entitled to a refund of the amount paid, without further compensation for damages or expenses.
7. CANCELLATION BY THE GUEST
If the Guest wishes to cancel a reservation or service, they must send a written notice to the Winery via email at vina.bedalov@gmail.com. The date the Winery receives the cancellation request will be considered the official cancellation date. Cancellation fees are as follows:
Cancellations made at least 7 days before the reserved date are fully refundable. Cancellations made within 7 days of the reserved date are non-refundable. The Winery will process refunds within 10 days of the cancellation request.
No-show policy: Guests who fail to arrive at the reserved time stated on their confirmation voucher are not entitled to a refund. If the Guest cancels the service after it has begun (without extraordinary circumstances), the Winery retains the full amount of the agreed price. If the Guest accepts a new date for the service, they waive any legal claims against the Winery regarding refunds or compensation.
8. WINERY OBLIGATIONS
The Winery guarantees to provide services in accordance with the descriptions in promotional materials (website, brochures, social media) and the contract. The Guest agrees to pay the Winery the agreed amount within the time specified in Section 4 – Payment. The Winery may share Guest information only with third parties directly involved in service execution or as required by law.
9. PRIVACY POLICY
We value your privacy and aim to clearly inform you about how we collect, use, and process your personal data. The Winery commits to safeguarding all information obtained about the Guest, including name, address, contact details, payment details, and any additional information voluntarily provided. Our Privacy Policy complies with the General Data Protection Regulation (GDPR), ensuring transparency regarding how we collect, use, and share your data. The Guest consents to the use of their personal data solely for reservation and service execution purposes. All personal data are strictly confidential and accessible only to employees directly responsible for service execution.
10. GUEST OBLIGATIONS
The Guest must inform the Winery of any health conditions, dietary restrictions, allergies, or other relevant personal information that may impact the service. Guests are responsible for ensuring they arrive on time and provide correct booking details.
11. GUEST SUBSTITUTION
If the Guest is unable to attend, they may transfer their reservation to another person by informing the Winery at least 12 hours before the scheduled service. The replacement Guest must meet all requirements for participation.
12. MINORS
Guests under 18 years old may participate in the experience only when accompanied by a parent or guardian and are not allowed to consume alcohol. The parent/guardian confirms their acceptance of these terms by signing the contract.
13. COMPLAINT RESOLUTION
If a Guest has a complaint during the service, they must immediately notify the Winery’s staff to allow the issue to be resolved on-site. If the problem is not resolved, the Guest must submit a written complaint to the Winery within 8 days after the service. Complaints without supporting documentation or submitted after the deadline will not be processed.
14. FINAL PROVISIONS
These General Terms and Conditions are an integral part of the contract between the Winery and the Guest. The Winery reserves the right to update the Terms and Conditions without prior notice. The official version is available on our website: https://vinabedalov.com/en/. By confirming their reservation, the Guest acknowledges and agrees to comply with these General Terms and Conditions.
